These Terms of Use (“Terms”) govern your access to and use of the website located at www.oncocapital.org and any related services, platforms, or digital tools operated by OnCo Inc. (“OnCo,” “we,” “us,” or “our”). By accessing or using our website or services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
OnCo Inc. is a nonprofit 501(c)(3) organization and mission-based lender operating as a Community Development Financial Institution (CDFI). These Terms are intended to be consistent with applicable nonprofit, lending, and consumer protection laws and regulations.
1. Acceptance of Terms
By accessing or using our website, submitting a loan application, or engaging with any OnCo digital service, you agree to these Terms and our Privacy Notice, which is incorporated herein by reference. OnCo reserves the right to update these Terms at any time. The most current version will be posted at www.oncocapital.org. Your continued use of our services following any update constitutes your acceptance of the revised Terms.
2. Description of Services
Through its website at www.oncocapital.org, OnCo provides access to resources including:
- Loan application and origination services
- Business education, financial literacy resources, and advisory tools
- Community impact information and program resources
- Third-party content, tools, and linked resources provided for informational purposes
All services are subject to these Terms. OnCo reserves the right, in its sole discretion, to modify, suspend, or discontinue any service at any time with or without notice. OnCo also reserves the right to decline or terminate access to services for violation of these Terms or applicable law.
3. Eligibility
Our services are intended for individuals and businesses who are 18 years of age or older and legally capable of entering into binding agreements. By using our services, you represent that you meet these requirements. OnCo’s lending services are subject to additional eligibility criteria as described in applicable loan program guidelines.
4. Loan Applications and Financial Services
OnCo provides mission-based lending services subject to separate loan agreements, program guidelines, and applicable federal and state lending laws.
Submission of a loan application does not guarantee approval. OnCo’s lending decisions are subject to its underwriting criteria, CDFI program requirements, and applicable fair lending obligations, including the Equal Credit Opportunity Act (ECOA) and the Fair Housing Act.
Loan products offered through OnCo may be originated, serviced, or processed in partnership with Loan Mantra. By submitting a loan application, you consent to the sharing of your application information with Loan Mantra and other service providers as necessary to evaluate and process your request.
OnCo is committed to responsible, transparent lending. We will clearly disclose all material loan terms, fees, and costs prior to loan consummation in accordance with the Truth in Lending Act (TILA), the Real Estate Settlement Procedures Act (RESPA) where applicable, and other applicable consumer financial protection laws.
5. Accuracy of Information
You agree to provide accurate, current, and complete information when using our services, including when completing loan applications and registration forms. You are responsible for maintaining the accuracy of information you provide and for updating it as necessary. OnCo reserves the right to suspend or terminate access for providing false, inaccurate, or misleading information.
6. Account Security
If you create an account in connection with a loan application or online service, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify OnCo immediately at hello@oncocapital.org if you suspect unauthorized access to your account. OnCo is not liable for any loss or damage arising from your failure to maintain account security.
7. Electronic Communications and Consent
By providing your phone number or email address, you consent to receive electronic communications from OnCo, including communications related to your loan application, account, or program services. If you also consent to receive text messages or automated calls, you agree to receive such communications as described in our loan application or program enrollment materials. Standard messaging and data rates may apply. You may opt out of marketing communications at any time by contacting us at hello@oncocapital.org.
By agreeing to receive electronic communications, you also consent to the use of electronic records to document your agreement, as permitted under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act).
8. Intellectual Property
The content on www.oncocapital.org, including text, graphics, logos, and software, is the property of OnCo Inc. or its licensors and is protected by applicable copyright and intellectual property law. You may access and use content on our website for personal, non-commercial, informational purposes only. You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission from OnCo.
OnCo grants limited permission to use documents such as press releases, program descriptions, and educational materials from our website for noncommercial informational purposes, provided that: (1) appropriate attribution to OnCo Inc. is included, and (2) the content is not modified or used in a misleading manner.
9. User Submissions
By submitting information, content, or materials to OnCo through our website or services, you grant OnCo a non-exclusive, royalty-free right to use such submissions in connection with the operation of our services, including for program administration, impact reporting, and service improvement. No compensation will be paid for submissions. You represent that you have the right to submit such materials and that they do not violate any third-party rights or applicable law.
10. Prohibited Uses
You agree not to use our website or services:
- For any unlawful purpose or in violation of applicable federal, state, or local law
- To submit false, fraudulent, or misleading information
- To impersonate any person or entity or misrepresent your affiliation
- To interfere with or disrupt the operation of our website or servers
- To attempt unauthorized access to any part of our systems or networks
- To transmit malicious code, viruses, or harmful software
- To collect information about other users without consent
- In any manner that could damage OnCo’s reputation or undermine its mission as a nonprofit CDFI
11. Third-Party Links and Resources
Our website may contain links to third-party websites or resources, including partner organizations, government agencies, and educational resources. These links are provided for convenience only. OnCo does not endorse, control, or assume responsibility for the content, services, or privacy practices of any thirdparty site. Your use of third-party sites is at your own risk and subject to the terms of those sites.
12. Disclaimer of Warranties
The information on our website and through our services is provided for general informational purposes and does not constitute legal, financial, tax, or investment advice. OnCo makes no representations or warranties, express or implied, regarding the accuracy, completeness, or suitability of any information provided.
Our services are provided “as is” and “as available” without warranty of any kind. To the fullest extent permitted by law, OnCo disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, and noninfringement.
13. Limitation of Liability
To the fullest extent permitted by applicable law, OnCo Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, our website or services. OnCo’s total liability to you for any claims arising under these Terms shall not exceed the amount you paid to OnCo in the twelve months preceding the claim, if any.
Nothing in these Terms limits OnCo’s liability for fraud, gross negligence, or violations of applicable consumer financial protection laws.
14. Indemnification
You agree to indemnify and hold harmless OnCo Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising from your use of our services, your violation of these Terms, or your violation of any applicable law or third-party rights.
15. Fair Lending and Non-Discrimination
OnCo Inc. is committed to fair, equitable, and non-discriminatory lending and service delivery. We comply with the Equal Credit Opportunity Act (ECOA), the Fair Housing Act, and all applicable fair lending laws. We do not discriminate on the basis of race, color, religion, national origin, sex, marital status, age, disability, familial status, or any other characteristic protected by law.
If you believe you have been subject to discriminatory treatment in connection with a loan application or service, you may contact us at hello@oncocapital.org or file a complaint with the Consumer Financial Protection Bureau (CFPB) at www.consumerfinance.gov.
16. Language Access
OnCo is committed to serving individuals with limited English proficiency (LEP). If you require language assistance, please contact us at hello@oncocapital.org. Our Language Assistance Plan is available upon request and on our website.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of South Carolina, without regard to its conflict of law principles, and applicable federal law. Any dispute arising under these Terms shall be resolved through good-faith negotiation. If negotiation is unsuccessful, disputes shall be subject to binding arbitration in Charleston, South Carolina, in accordance with the rules of the American Arbitration Association, except where prohibited by applicable law. Nothing in this section limits your rights under applicable consumer financial protection laws.
18. Modifications
OnCo reserves the right to modify these Terms at any time. Updated Terms will be posted at www.oncocapital.org with a revised effective date. Your continued use of our services after any modification constitutes acceptance of the updated Terms.
